THE LAW

The report of the Road Task Group to the Government was ‘that there is no need for new legislation in this area as existing legislation is enough to prosecute companies’. However, the new Corporate Manslaughter bill will apply to road risk.


THE ISSUES

Many Directors are unaware of the risks in this area. Office furniture health and safety often takes precedence over road risk. This is now changing.

 



RECENT CIVIL CASES


A common reason for no action is there have not been many cases. This is not true and in the Metropolitan Police, there is now a squad of detectives who investigate every serious road traffic accident, including investigating directors.

CURRENT CRIMINAL LEGISLATION

There is no need for new legislation. Seventy-five percent of the Health and Safety at Work Act 1974 applies to use of a vehicle as a place of work. Read an overview of all the current legislation which applies.
